Consumer Protection Law

Africa-Press – Angola. The Constitution of the Republic of Angola establishes fundamental rights and freedoms and creates the political, economic, social, cultural, peace and stability conditions that guarantee their effectiveness and protection.

According to the law, the consumer has the right to the quality of goods and services, to information and clarification, guarantee of their products and protection in the consumption relationship. The consumer also has the right to be protected in the manufacture and supply of goods and services, and must be compensated for the damages caused.

Advertising of consumer goods and services is regulated by law, and all forms of hidden, indirect or misleading advertising are prohibited.

Most of the conflicts arising from consumer relations, specifically in Angola, have as their cause the quality of goods and services. For certain authors, this right appears first in the list of consumer rights enshrined in the LDC, given the special importance it assumes in consumer relations.

When purchasing a good or service, the first thing that is expected is that it corresponds to the interests or needs that led to the acquisition. Goods and services intended for consumption must be able to satisfy the purposes for which they are intended and produce the effects attributed to them. This means that the right to the quality of the goods and services consumed ensures both the suitability of the goods and services for the purposes for which they are intended, as well as the absence of any defect (product tampering, poor service quality) of utility or functioning, linked to to their characteristics.

The quality of goods and services must be assured after a certain period of time after their purchase. In the case of the purchase of a movable asset (a camera, washing machine or bicycle), the supplier must guarantee its good condition for a period of one year or a longer warranty period, as agreed between the parties.

If the good has a problem and needs repair during the warranty period, this period is suspended for the duration of the repair, starting again from the end of the repair.

In the event of a lack of conformity of a good or service, the consumer has the right to demand repair, replacement, price reduction or termination of the contract.
