The courts in the districts of Lubango, Matala, Caconda and Quilengues, in the province of Huíla, will have guarantee judges in the next judicial year (2023), to better safeguard the fundamental rights and freedoms of citizens, especially in the preparatory instruction phase of the Law Suit.
The guarantee judge provided for in the Code of Criminal Procedure, which came into force in February 2021, among various functions, is responsible for applying personal coercive measures, with emphasis on preventive detention, until now in charge of public prosecutors. , in the preparatory instruction phase of the processes.
In addition to applying the personal coercive measures in the preparatory instruction phase, the guarantee judge will pronounce the cases.
The guarantee was given on Wednesday, in the city of Lubango, by the accompanying member of the Superior Council for the Judiciary, António Santana, at the end of the verification of the conditions of accommodation of the court of the district of Caconda, considered propitious for the purpose.
Without giving figures, he said that the council intends for the guarantee judges, provided for in the Constitution, to start operating in the next judicial year, hence it was necessary to create conditions for them to come into operation.
“Here, at the level of the Caconda district court, we believe that there are conditions, both in terms of physical infrastructure, and also in terms of magistrates to exercise this function, not least because in the municipality there is already a previously trained judge to exercise the functions of guarantee judges “, said.
António Santana stressed that at the level of the Lubango District Court they need to make some adjustments for the implementation of these guarantee judges, but nothing prevents it from being implemented.
The province of Huíla, which is part of the fourth judicial region, has four district courts, namely Lubango, Caconda, Matala and Quilengues, the latter still to be inaugurated.
