Africa-Press – Botswana. Ministry of Justice and Correctional Services intends to amend the Administration of Estates Act and other related statutes to expedite the resolution of estate cases to improve efficiency.

Answering a question in Parliament on Tuesday, Assistant Minister, Mr Augustine Nyatanga also said they were considering using the customary law processes to include administration of estates, which would require the amendment of the Administration of Estate Act.

He also said government had various plans in place to expedite the resolution and disposition of the administration of estate cases. The assistant minister said these included the delinking of the Office of the Master from the Office of the Registrar of the High Court, which was in progress. He said a Senior Assistant Master had been deployed to Francistown High Court to service the customers requiring the services of the Master’s Office to address the issue of delayed services.

Mr Nyatanga said in the near future, Estate Controllers would be appointed to assist in the delivering of the Master’s services to the people in their respective areas. He further said they were also considering utilising Magistrates Courts as centres for providing Master’s Office services.

The assistant minister said the next of kin meetings were currently conducted in and outside Gaborone and some have been held on Saturdays since June 16.Meanwhile, he further told Parliament that the Gaborone High Court had 4 964 ongoing or pending estate files and 10 923 active Guardian’s Fund estates files.

He also said there were also 90 company liquidations, 12 Incapacitation files, 18 Judicial Management and six insolvency files. He further said the Francistown High Court had 3 998 Estate files, 9582 Guardian’s Fund files, three liquidation and 18 Incapacitation files. He was responding to a question from Bobirwa MP, Mr Taolo Lucas, who had asked the minister to state the total number of Administration of estate cases that were unresolved before the Master of the High Court.

He further asked the minister to state the current and future plans for expediting the resolution and disposition of the Administration of estate cases. MP Lucas also wanted to know if there were any legislative proposals his ministry sought to bring before Parliament that could help expedite the resolution of the estates cases.
