Africa-Press – Cape verde. The Decree-Law that regulates the use of State vehicles on weekends and public holidays by public service managers provides for fines ranging from 10,000 to 70,000 escudos for offenders. Published on the 27th of January, this diploma comes into force within a period of 30 days from the date of its publication.

The measure, as Inforpress advances, is contained in Decree-Law No. 10/2023 published on January 27 in the Official Bulletin (BO), and falls within the need for progressive rationalization of costs and reinforcement of control and discipline in the use of this public good, that is, State vehicles and civil service.

The implementation of the new legal regime, which governs in a “global, effective and coherent way” the management of the State’s fleet of vehicles, covering acquisition in any of its modalities, leasing, assignment, use, inspection, scrapping alienation or destruction.

Who does it apply to?

The measure applies to the direct administration of the State, regardless of its degree of autonomy or independence, to services, public institutions and public companies, regulatory agencies, foundations and public associations, autonomous funds and services, as well as projects financed under the international cooperation and public development aid.

This diploma does not apply to institutions that, for special security reasons or the nature of the service provided, namely the courts, the Attorney General’s Office, the Armed Forces, the National Police, hospitals, health stations and diplomatic representations and consular offices, are or will be regulated by a special diploma.

The document also reinforces the legal tools that support the implementation of the centralized management of the State’s fleet of vehicles, based on criteria of strict efficiency and economic rationality and with a reduction of operating costs.

The concept of improper or abusive use of State vehicles is considered to be the driving of State vehicles for personal purposes by persons who are not duly authorized by the law.

The diploma also provides for a disciplinary offense to circulate in State vehicles after 8:00 pm on weekends and national or municipal holidays, except for cases in which circulation is made for the purpose of a service authorized punctually under the terms of this diploma and of e. to the workplace or other place of personnel to whom the law does not grant the respective right.

However, the National Police and other supervisory bodies must immediately report to the central service responsible for State Heritage and to the vehicle service or entity any facts that could constitute an offence.
