Africa-Press – Kenya. Lawyer Donald Kipkorir has dismissed reports that IEBC commissioner Irene Masit has resigned. In a statement on Thursday, Kipkorir who is representing Masit said they have filed a petition against the ouster process.

“IEBC Irene Masit has given me firm instructions to quash her unconstitutional impeachment proceedings by Writ of Certiorari. We have already filed a Constitutional Petition in High Court, Nairobi,” he said.

“Any reports that she has resigned are the work of political brokers and idlers.” The clarification comes hot on the heels of reports that she had resigned from office.

On Thursday morning, Francis Wanderi filed his resignation saying it was a pre-determined decision, becoming the third of the four commissioners to do so. The other two, Justus Nyang’aya and vice chairperson Juliana Cherera also resigned.

“It is with immense woe that today I tender my resignation as commissioner and vice chairperson of the Independent Electoral and Boundaries Commission,” Cherera wrote on Monday.

The four were suspended from office on Thursday, December 1, by President William Ruto. The decision followed a recommendation by the National Assembly’s Justice and Legal Affairs Committee.

A tribunal was appointed to probe into the accusation facing the commissioners, which include gross misconduct. The tribunal is led by High Court Judge Aggrey Muchelule.
