Africa-Press – Kenya. Nick Mwendwa is set to resume his role as Football Kenya Federation president after being cleared of the Sh 38 million theft charge brought against him by the Director of Public Prosecutions, Noordin Haji last July.

Mwendwa relinquished the position on November 31, 2021, and gave his deputy, Doris Petra, control of the local governing body.

He was accused of allegedly stealing Sh2,500,000 from the federation on May 15 of last year, according to the first theft charge.

According to the second accusation, Mwendwa allegedly stole Sh 5 million on March 4 of last year. He was further charged over claims of stealing Sh 1 million on May 6 last year and conspiring with others who were not present in court to defrauding FKF of Sh29,502, 709. Mwendwa was first arrested on November 11, 2021, and produced in court three days later.

On November 11, 2021, Mwendwa was initially detained and was then presented in court three days later. Kiambu Senior Principal Magistrate Wilson Rading deemed the charges unlawful, in violation of the constitution, unfounded, and an abuse of the legal system.

The DPP has been barred from filing any charges against Mwendwa or even calling him in for a deposition following Rading’s intervention.

“This honorable court hereby issues orders to the effect that the charge sheet dated July 7, 2022, and or any other charge sheet prepared and registered in this court by the DPP and or his prosecutor (s) against the accused person after July 6, 2022, be and is hereby struck out for being defective, unlawful, unconstitutional and for being an abuse of the court process/criminal justice system.”

“Football which is a beautiful game suffers when there is push and pull of this kind. What is the fate of the thousands of youth who wake up in the morning to go to the fields to play football? Will they rise to the level of Lionel Messi or Kylian Mbappe and is theirs a lost cause?”

According to Rading, Mwendwa had established that his trial had been unfair and that there had been an excessive delay.
