The Chief Administrator (CA) of the Namibian Sports Commission (NSC), Simataa Mwiya and the Minister of Sports, Youth and National Services, Agnes Tjongarero, have come to an agreement that Mwiya will remain in his position as CA until the matter between the two parties is finalised.
An agreement that Mwyia and the Minister signed on Friday stipulates that Mwiya will not seek an interdict to prevent the minister from advertising the CA position. Furthermore, the agreement also states that Mwiya accepts the salary of the first tier of the schedule of the State-Owned Enterprise (SEO).
Another court hearing then took place on Monday, where the parties signed another agreement that specifies that the matter has been postponed to 9 August for a Case Management Conference hearing.
Monday’s agreement also stipulates that the minister should prove why her decision to go against the NSC’s recommendations to renew Mwiya’s contract as the Commission’s CA, should not be reviewed.
This comes after the minister wanted to advertise the board’s CA position, although the NSC board, chaired by Joel Matheus, recommended that Mwiya should be reappointed as CA for another five years.
According to Monday’s agreement, the minister also has to prove why her decision to go against the board’s recommendations was not in violation of Article 18 of the Namibian Constitution, which requires that “administrative bodies and administrative officials shall act fairly and reasonably and comply with the requirements imposed upon such bodies and officials by common law and any relevant legislation”.
In this regard, the agreement also calls for her to prove why she should not be ordered to act under section 23(1) of the Namibia Sports Act 13 of 2003, which requires that the minister must appoint the board’s CA according to the recommendations of the Commission.
Tjongarero last week relieved the entire board of the Namibia Sports Commission (NSC) of their duties with immediate effect. The members include Joel Matheus, who was the chairperson, Erica Beukes, Alna Similo, Thomas Mbeeli, Karen Mubonenwa, Dr. Marius Johannes, Nicklaus Ngumono and Linda Chicalu.
