Africa-Press – South-Africa. ActionSA wants the Gauteng High Court to declare as unlawful a City of Tshwane council rule which allows the municipality’s speaker to unilaterally throw out motion of no confidence petitions to remove him.

On Thursday, a second attempt to remove Mncedi Ndzwanana failed when he dismissed a motion submitted by ActionSA.

In April, Ndzwanana had successfully dismissed a motion to remove him by stating it was frivolous. The exact reasons were given on 29 June.

ActionSA believes Ndzwanana is not fit to hold the position of speaker.

In March, he was elected to the role after a chaotic council meeting that saw his support from the ANC and EFF and ballots from DA councillors being spoilt.

Ndzwanana is a member of the African Transformation Movement.

ActionSA and the DA believe his removal is essential to ensure stable governance under the coalition government.

The coalition already had DA councillor Cilliers Brink as mayor, but the election of a candidate from this grouping would help create stability, ActionSA said.

The party’s Tshwane caucus leader, Jackie Mathabathe, added the court case was necessary because Ndzwanana had contravened council legislation by refusing the motion to be debated.

He would be removed if the motion is heard, as the DA coalition has a set advantage in the council.

“True to the nature of an ANC and EFF remote-controlled puppet speaker, Ndzwanana unlawfully dismissed the motion of no confidence at a council sitting on Thursday afternoon, highlighting yet again why he will put his political masters ahead of the principles of good governance.

“The shenanigans are characteristic of the EFF-ANC unholy alliance and is a clear indication that if Ndzwanana is left to preside over the council, the work of the council will continue to be frustrated – thereby reducing the efficient operations of the city.

“ActionSA, a party which values ethical leadership, cannot allow the City of Tshwane council to disintegrate into chaos, and will therefore head to court to ensure that the proper functioning of the council is restored,” Mathabathe.

The court application is expected to take place next week.
