Africa-Press – South-Africa. Nafiz Modack and his large group of co-accused might finally have their case, which centres on the murder of Anti-Gang Unit (AGU) detective Charl Kinnear, transferred to the Western Cape High Court for trial preparations on Friday.
The case was on the brink of being transferred earlier in April, when Modack’s lawyer complained the hard drive containing thousands of documents submitted so far was useless to him in prison as he had no access to a computer.
There was an agreement to sort this out, but a new magistrate decided the case was not yet ready to move to pre-trial, to the disappointment of the three prosecutors present.
Modack was arrested in Cape Town on 29 April 2021 and has been in custody ever since.
He claims senior figures in the police are setting him up, and in one affidavit, said he was being targeted for trying to get drugs out of nightclubs.
The 15 were, however, given hard copies of their thick indictments at the last appearance.
Modack, Zane Kilian, Jacques Cronje, Ziyaad Poole, Bubbles Brown, former AGU officer Ashley Tabisher, Amal Jantjies, Jannick Adonis, Fahmeed Kelly, Modack’s brother Yaseen, Mario Petersen, Petrus Visser, Muhamed Mukadam and Ricardo Morgan collectively face thousands of charges.
They range from murder and attempted murder, racketeering, unlawful possession of firearms and ammunition, a hand grenade plot, kidnapping, money laundering and communications interception to illegal location tracking.
Each accused purportedly carried out specific tasks within what the State alleged was a racketeering network involving input from gangs such as the Junky Funkies and Terrible Westsiders.
The murders include the killing of Kinnear and Nici Heerschap, the father of a Hawks officer who was investigating Modack, and tow truck driver Richard Joseph.
The attempted murder case relates to a shooting at Cape Town lawyer William Booth’s home in 2020, and a shooting directed at security company owner André Naude’s home in 2019.
Naude is one of a diminishing list of accused in a trial involving a separate case – the murder of “Steroid King” Mark Wainstein.
In that case, which includes businessman Mark Lifman, three of the accused have been murdered.
Modack’s court appearances involve huge groups of heavily armed specialist officers and tightly guarded court rooms.
