Africa-Press – Zimbabwe. HARARE, June 3 (NewsDayLive) -An 81 year old Harare woman has approached the courts seeking to repossess a house that she donated to her late son, accusing her daughter-in-law and grandson of betrayal and ingratitude.

Jane Chipiti (81) appeared before High Court Judge Fatima Maxwell on Monday seeking to repossess the property located at Number 3762 Dzivarasekwa 4, which she had donated to her now late son Johannes Dembaremba in September 1994.

Dambaremba passed away in 2022 and had lived on the property with his wife Chenai Tepalepa (56) and their children.

Following his death, Chipiti claimed her daughter-in-law neglected her, destroyed the property and labeled her a witch.

The mother-in-law is now seeking revocation of the donation, arguing that the recipients, her daughter-in-law and grandson, have displayed ingratitude, which legally undermines the continued validity of the donation.

Chipiti, who is being represented by Rufu Makoni, told Justice Maxwell that the alleged ungrateful conduct gives rise to justifiable grounds to revoke the gift, and urged the court to order the Registrar of Deeds to effect the re-transfer of the property back into her name.

Tepalepa and her son, who are opposing the application, are being represented by Scott Mamimine.

ln her application for a declaratur, Chipiti submitted that she was blessed with only one son Dembaremba and his father died in 1978 when he was doing Grade Two and she raised her son single handedly.

Chipiti submitted that in 1989 she managed to acquire an immovable property 3762 Dzivarasekwa 4, and donated it to Dembaremba in September 1994.

She told the court that the main condition for the donation was that Johannes would extend the house on her behalf.

She told the court that the donation was also made on the understanding that even if the property was to be registered in Dembaremba’s name, she would still have undisturbed rights over it until her death.

Chipiti said she was diagnosed with diabetes, and her daughter-in-law is failing to provide for her medication, hence her bid to revoke the donation.

The matter is ongoing.
