Africa-Press – Angola. The Constitutional Court (TC) dismissed UNITA’s request to declare the unconstitutionality of a rule of the Rules of the National Assembly (AN) invoked in the context of the process of dismissal of the President of the Republic.
In its decision, which appears in a ruling distributed this Thursday, the TC explains that the UNITA Parliamentary Group requested the declaration of unconstitutionality of rule no. Republic of Angola (CRA).
According to the document, UNITA considers that the rule in question gives the AN Plenary “powers that conflict with those established in numbers 3, 4 and subparagraphs b) and c) of no. 5 of article 129 of the Constitution”.
Among their arguments, the 10 judges who signed the document consulted highlight that, within the scope of the process of dismissal of the President of the Republic, the initiative “must be duly substantiated and is the responsibility of the National Assembly”.
It adds that the “initiative” proposal is presented by one third of the deputies currently in office and the deliberation is approved by a majority of 2/3 of the parliamentarians in office, after which the respective communication or procedural petition must be sent to the Court Supreme Court or the Constitutional Court, as the case may be.”
He explains that the UNITA Parliamentary Group failed to mention the moment in which the processes were initiated, which is the responsibility of the National Assembly, as expressly prescribed by the Constitution.
He considers that the moment of the initiative of the processes of criminal liability and dismissal of the President of the Republic by the AN “is not to be confused” with the moment of the proposed initiative.
The latter must be presented by a third of the deputies currently in office, according to the constitutional jurisdiction, clarifying that the two moments are assumed by different entities.
Last October, the AN Plenary failed the process of initiating the accusation and dismissal of the President of the Republic, João Lourenço, formalized by the UNITA Parliamentary Group.
The initiative of the largest opposition party was rejected with 123 votes against from the MPLA and Humanist Party of Angola (PHA) and an abstention from the Social Renewal Party (PRS).
