Africa-Press – Cape verde. The government created a commission to revise the Civil Code, in force since the colonial period, to adapt it to social, economic, and technological demands, according to a decree published today in the Official Gazette.

“Considering the opportunity to promote a profound and structural reform of Cape Verdean civil law, taking advantage of best practices and recent international legislative reforms, the Revision Commission was created to prepare studies for a possible update of the Civil Code,” the document reads.

The current code was approved by the Portuguese State in 1966 and extended to the then overseas provinces, during a period of colonial rule.

After independence, Cape Verde maintained this legal regime, which has undergone several specific changes over the past few decades.

The government acknowledges that the “fragmented legislative evolution” has created gaps and inconsistencies, especially in areas such as the use of electronic means for legal acts, which the original legislation “understandably, given its temporal position, could not address.”

The commission will have 18 months to present its final results, which could be a draft of the new Civil Code.

The new commission will be composed of legal experts from various areas of civil law, including representatives from the Public Prosecutor’s Office and the Brazilian Bar Association, and may also include sociologists and anthropologists.

The work will be supported by the Ministry of Justice and may include national and international technical opinions.
