Senate Receives Kericho County Assembly Impeachment

Africa-Press – Kenya. The Senate has formally received communication from the Kericho County Assembly regarding the impeachment of Governor Eric K. Mutai.

Mutai was impeached following a resolution passed by all 33 members of the County Assembly (MCAs) last week.

In a letter addressed to Senate Speaker Amason Kingi, Kericho County Assembly Speaker Patrick Mutai confirmed that the impeachment motion was passed on Friday, August 15, citing various grounds including misappropriation of public and donor funds and abuse of office.

“On Friday, August 15, 2025, the County Assembly of Kericho, vide its resolution and pursuant to Article 181 of the Constitution of Kenya 2010, Section 33 of the County Governments Act, 2012, and Kericho County Assembly Standing Orders 70 and 70A, approved the motion to remove H.E. Dr. Erick K. Mutai from office by way of impeachment,” read the letter in part.

The letter included a comprehensive schedule of evidence, proceedings, and documentation submitted to support the impeachment motion.

According to the County Assembly, this submission complies with Section 33 (2)(a) of the County Governments Act and Standing Order 70 (13)(a).

Mutai was impeached after a heated session at the County Assembly, where he mounted a spirited defense throughout the day.

However, the MCAs remained unconvinced, with all 33 voting unanimously in support of the motion, marking the second attempt to remove him from office.

The impeachment motion was initiated by Sigowet Ward MCA Kiprotich Rogony, who accused the governor of overseeing the illegal payment of Sh85 million to contractors for incomplete or non-existent projects. The governor has vehemently denied the allegations.

The process had briefly been halted by the High Court in Kericho after two petitioners challenged its legality, arguing that it violated due process. However, the assembly proceeded with the vote once the legal hurdles were cleared.

With the matter now before the Senate, the next step will be for the Speaker to convene a special sitting to determine whether to form a special committee to investigate the charges or proceed with a plenary hearing.

Mutai now faces the possibility of being permanently removed from office if the Senate upholds the County Assembly’s resolution.
