Africa-Press – Namibia. Ejected Namibia National Paralympic Committee (NNPC) president Johannes Litwayi has lodged an appeal with the Namibia Sports Commission (NCS), challenging the appointment and legality of the interim committee.
Litwayi has submitted the notice of appeal to the NSC and its chairperson, Turky Ndashiva, to review its decision in terms of the Namibia Sports Act 12 of 2003.
In the appeal documents, Litwayi and the NNPC, both second and first applicants, jointly applied for the review of the decision taken by the first respondents (NSC), second respondent NSC chairman Turky Ndashiva, third respondent NSC chief administrator Simaraa Mwiya, and fourth respondent the interim committee of the NNPC, to review, correct and set aside the decision and action of not complying with the Sport Act or the NNPC’s constitution.
The appeal further states that the appointment of the interim committee members, Daniel Trump, Yvonne Hansen, Johanna Haifiku, Johannes Matias, and Pandulo Sheehama, was irregular, defective, and null and void.
The five members received their appointment letters for an initial period of three months with the option of an extension.
The appointment by NSC chief administrator Freddy Mwiya followed the special election at the annual general meeting held on 2 April, during which the officials were elected as interim members.
The appeal reads that the establishment of the NNPC interim committee was unconstitutional and unlawful.
It says the decision taken by the second, third, and first respondents did not comply with the NNPC’s constitution, and thus calls for an order declaring the substantive board members elected on 2 March 2022 as valid in terms of the NNPC’s constitution for a four-year term ending 1 March 2026.
It further calls for an order declaring that there is no leadership vacuum at the NNPC, urging the NSC appeal committee to take any alternative relief it deems appropriate.
The appeal document says a copy of the appeal notice or application will be served on the parties physically via the deputy sheriff, and where not possible, via email.
Other respondents included in the appeal are Disability Sport Namibia, Africa Paralympic Committee, International Paralympic Committee, the Ministry of Education, Innovation, Youth, Sport, Arts and Culture, NNPC former treasurer Jean Paul Schmidt, and members of the board elected on 2 March 2022.
On 8 August this year, the NNPC interim committee, of which the term of office ends early next month, terminated the services of the NNPC long-serving secretary general Micahel Hamukwaya, but urged Hamukwaya to remain an active coach of disability sport.
Following its appointment, the interim committee reiterated its mandate that it is the only committee that will make all decisions in the future.
Meanwhile, efforts to get comment from the NSC’s chief administrators and interim NNPC committee chairman Daniel Trump proved futile.
