Africa-Press – Angola. The new General Labor Law (LGT), which comes into force in March, guarantees greater protection for employees within the scope of the legal-labor relationship, said, this Tuesday, the director of the Legal and Exchange Office of the Ministry of Public Administration, Labor and Social Security (MAPTSS), David Kinjinca.

David Kinjinca was speaking in Benguela, which hosts from today to Wednesday the training and dissemination seminar on the new General Labor Law, Law no 12/23, of December 27th, aimed at public and private employers, sovereign bodies, trade unionists, as well as social partners and magistrates.

The training event, part of the cycle of seminars that MAPTSS has been holding since February 1st, across the country, is expected to train more than a thousand people simultaneously in the cities of Benguela and Lobito.

At the opening, the person responsible stated that the experience of implementing Law 7/15, which ends on March 26, showed the need to introduce reforms, so that there is greater harmony, balance and protection of workers.

For him, the retreat of the State, as an entity of good, in certain provisions of the legal-labor relationship, resulted in a new law that is more consensual and balanced regarding the need to safeguard both the interests of workers and the productivity of companies.

Speaking on behalf of the Ministry of Public Administration, Labor and Social Security, David Kinjinca also highlighted the main changes to the General Labor Law, such as the indefinite employment contract as a rule.

In this way, he says, the aim is to better safeguard the position of workers, giving them more guarantees and thus avoiding precarious employment.

According to him, Law 7/15, still in force, gave workers the possibility of staying up to 10 years on a fixed-term contract, for small, medium-sized and micro-enterprises.

However, he explained that the census carried out by the National Statistics Institute (INE) in 2021 proved that almost 95 percent of Angolan companies are classified as small, medium and micro.

“Therefore, more than 95 percent of the cream of Angolan workers were in a precarious situation”, he said, reporting on the negotiations with the unions and the business class, so that the indefinite period contract could now be defined as a rule, of in order to guarantee greater job stability.

Disciplinary measures

For the director of the MAPTSS Legal and Exchange Office, in addition to guarantees for workers, there was also a reinforcement of disciplinary measures available to employers, so that companies are more productive in achieving their objectives.

Among these measures is the temporary suspension of work with partial loss of remuneration, so the person responsible considers that the new LGT represents a fair balance between protection measures for both workers and employers.

On the other hand, David Kinjinca highlighted that the subject of personality rights was still subject to regulation in this law, so that, within the scope of legal-labor relations, workers and employers “do not lose their human side and dignity”, enshrined in the Constitution of the Republic.

Disclosure

Regarding the national plan for disseminating the new General Labor Law, he highlighted the objective of making this diploma a landmark for stability in legal-labor relations.

“The General Labor Law is not just any law. It is a law that, due to its importance, the State uses as an instrument to materialize the economic and social rights set out in the Constitution”, he assured.

Likewise, it recognizes that labor relations are fundamental to guaranteeing the prosperity and good of society, thus avoiding strikes and dissatisfaction that can create social instability.

Hence he added that the province of Benguela was chosen to host the second largest training seminar on the new LGT, with the aim of reaching more than a thousand trainees from public administration, companies, the General Labor Inspection services, Aniesa, unions and business associations.

He believes that, with the knowledge that national staff will acquire during these days, it will become easier to comply with and apply Law No. 12/23, from March 26th, the date of its entry into force.
