Parliament approves draft law on the Labor Procedure Code

Africa-Press – Angola. The National Assembly (AN) approved, this Thursday, in general, the Proposal for the Law on the Code of Labor Procedure, which is characterized as a primordial instrument for the development of the labor justice system.

The Law Proposal, on the legislative initiative of the Executive, was approved with 166 votes in favour, no votes against and no abstentions, at the 6th ordinary plenary meeting of the 1st Legislative Session of the V Legislature.

The Minister of Justice and Human Rights, Marcy Lopes, indicated, on the occasion, that the diploma is fundamental for the Angolan legal system, due to the fact that it faces difficulties related to these matters, among which the lack of of a legal instrument that unifies the norms of the labor process.

He said that there is a need for unification and systematization of the various separate rules on procedural labor law, for a better search for legal certainty and security.

Among the main alterations to be introduced in the document, emphasis should be placed on the reformulation and characterization of procedural assumptions, with emphasis on judicial capacity, legitimacy, the prerogative of representing the State and other persons designated by law, such as the Public Ministry.

The document also aims to change the legal representation regime, with the introduction of non-compulsory constitution by the parties, which now have at their disposal a wide range of options for the realization of the right to defense in court.

The legislative initiative is, on the one hand, a policy measure included in the National Development Plan 2018-2022, being framed in the strategic axis of Economic, Sustainable and Inclusive Development which is embodied in the guarantee of working conditions.

On the other hand, it emerges as an action based on the Executive Government Program, presented in the context of the 2017 election under the motto “correct what is wrong, improve what is good”.

This assumption, according to the background report, establishes the improvement of organization and working conditions and labor relations as a strategic policy measure to encourage the enhancement of human capital and the promotion of qualified and remunerated employment.

With the legislative initiative, it is also intended to densify the axiological-normative content of the fundamental principle and the structuring principles of the rule of law.

Debate on territory management

Before the period on the agenda, the deputies debated on the management of the territory and the supervisory role of the National Assembly, at the simultaneous request of the MPLA and UNITA parliamentary groups.

The motto for this debate is related to the demolitions of the Zango III neighborhood, in Luanda, which were due to constructions considered irregular, as they were carried out in the perimeter destined for an electrical energy substation.

By the way, deputy Paulo de Carvalho, from the MPLA, said that “they contacted the authorities, who realized that they had prohibited such constructions and embargoed the works that, however, continued in the dead of night or during the weekends”.

The deputy estimated that, in the period 2022-2023, “there have been around 400 demolitions in the province of Luanda, mostly of precarious housing”.

“In this matter we have to assume responsibilities, citizens do not always behave properly, choosing to build in inappropriate places, trying to deceive in order to get more than one residence in case of rehousing”, he stressed.

According to the deputy, when it is necessary for the authorities to put their foot down saying enough is enough, “what happens is lamentations from some and others as if there was no responsibility to assume”.

He also stated that most of the demolitions take place by judicial decision.

“But we also have to assume that the administrative authorities have failed, when they first allow construction, even knowing that they occur in inappropriate places and then fail again when they turn a blind eye to the less proper acts of some of their administrative and fiscal agents, more concerned with their own benefits. It is these practices that we have to fight energetically”, he expressed.

President of AN praises gesture by UNITA deputy

During the session, the President of the National Assembly, Carolina Cerqueira, praised the initiative of the UNITA deputy, Domingos Palanga, who apologized for the exaggerated way in which he addressed the plenary debate on Wednesday (20) in response to an intervention by the MPLA deputy, José Miúdo Ndambuca.

Carolina Cerqueira said that she had taken good note of the younger deputy’s gesture of humility, education and respect, which raises the civic spirit of the House of Laws.

The President of AN requested that the gesture serve as a future reference in debates at the House of Laws.
