What You Need to Know

Kenya’s Ministry of Trade announced its intention to appeal a court ruling that suspended its economic partnership agreement with the European Union. The ruling, issued by the East African Court of Justice, was based on a lawsuit claiming Kenya’s unilateral signing of the agreement violated regional treaty provisions.

Africa. Kenya’s Ministry of Trade announced its intention to appeal a court ruling issued by the East African Court of Justice, which suspended the economic partnership agreement signed between Nairobi and the European Union.

The court’s decision followed a lawsuit filed by a regional research center, which argued that Kenya’s unilateral signing of the agreement contradicted the provisions of the East African Community treaty, which includes eight countries and aims to coordinate trade and economic policies among its members.

The agreement came into effect in 2024 and aims to facilitate the entry of Kenyan exports, particularly flowers and fruits, into European markets, in exchange for opening the Kenyan market to European products and gradually reducing tariffs over 25 years.

However, regional trade experts criticized the move, stating that the agreement should have been concluded with the entire group rather than a single country, as this could impact the unified negotiating position of East African nations.

Despite this, the agreement remains open for other countries to join later.

Economic Importance and Regional Implications

The suspension of the agreement poses a significant challenge for Kenya, as its trade volume with the European Union reached approximately 3 billion euros in 2023, including exports valued at 1.2 billion euros.

The European market is viewed as a crucial outlet for Kenyan agricultural products, at a time when Nairobi is striving to enhance its status as a regional trade hub. Observers believe that the issue transcends trade, raising questions about the future of economic integration in East Africa and the group’s ability to negotiate as a unified bloc with major international partners like the European Union.

The East African Community (EAC) is a regional intergovernmental organization comprising eight member states, established to enhance economic, political, and social integration. The EAC has been working towards a common market and customs union to facilitate trade among member countries. The recent court ruling against Kenya’s trade agreement with the EU highlights the complexities of regional trade policies and the necessity for collective negotiations among EAC members.

Since the agreement’s implementation in 2024, it has aimed to boost Kenyan exports, particularly in agriculture, by providing access to European markets.
